France to help Syria's "liberated zones"

NEW YORK (Reuters) - France plans to channel aid to rebel-held parts of Syria so that these "liberated zones" can administer themselves and staunch an outflow of refugees, Foreign Minister Laurent Fabius said.

He said France and Turkey had identified areas in the north and south that had escaped President Bashar al-Assad's control, creating a chance for local communities to govern themselves without feeling they had to flee to neighboring countries.

"Maybe in these liberated zones Syrians who want to flee the regime will find refuge which in turn makes it less necessary to cross the border whether in Turkey, Lebanon, Jordan or Iraq," Fabius said after a U.N. Security Council meeting in New York on Thursday.

However, civilians in rebel-held parts of Syria have suffered frequent deadly air strikes from Assad's forces.

It was not clear how Fabius's promise to allocate much of its future 5 million euros ($6.25 million) aid for Syria to these areas would protect civilians and deter them from fleeing.

"What we can see is that the opposition has taken strong positions in liberated zones in the north and south," Fabius said. "Those resisting who have taken control of certain zones and municipalities need to administer these areas."

Credible protection for "liberated" areas would require no-fly zones patrolled by foreign aircraft, but there is no chance of securing a U.N. Security Council mandate for such action, given opposition from veto-wielding members Russia and China.

Western powers have also said they will not supply weapons to lightly-armed Syrian rebels, who have few answers to attacks by Assad's combat planes and helicopter gunships.

After the council meeting to discuss the humanitarian crisis ravaging Syria after 17 months of conflict, Western powers said military action to secure safe zones was still an option.

But they have shown little appetite for sending warplanes to Syria to protect safe havens or mount the kind of NATO bombing that helped Libyan rebels topple Muammar Gaddafi last year.

Up to 300,000 Syrians have fled the country, while many more are displaced inside, humanitarian agencies say.

Turkey, which has called for buffer zones to be created, now hosts more than 80,000 Syrian refugees and the U.N. refugee agency says the eventual figure could reach 200,000.

The United Nations questioned the idea of buffer zones. "Bitter experience has shown that it is rarely possible to provide effective protection and security in such areas," said U.N. High Commissioner for Refugees Ant?nio Guterres.

Fabius said more help must be given to rebel-held areas.

"We need to help them financially, administratively, sanitarily and in terms of equipment. We are helping them directly as is Turkey," the foreign minister said.

Paris and Ankara were working to identify individuals in these zones who could be part of a future Syrian authority.

"In the Syria of the future, these people will play an important role because they have emerged out of the conflict and they have the trust of the population," Fabius said.

State Department spokeswoman Victoria Nuland said earlier this week that the United States had started programmes for administrators in territories outside Assad's control.

"We have been working with them on issues of civil administration, human rights training, the kinds of things that they might need from the international community as they begin to rebuild their towns," she said.

Nuland said the training involved programmes outside Syria for those able to leave the country and "pretty extensive contacts" with those unable to leave.

"They are asking for help in how to budget, they are asking for help in how to keep utilities running, how to ensure that the institutions of the state that provide services to the population come back up and running," she said.

The United Nations says nearly 20,000 people have been killed in Syria since the uprising against Assad began in March, 2011. Syrian opposition groups put the death toll far higher.

Retailers report best sales growth since March | Business | Eugene ...

NEW YORK (AP) - This summer, Americans were walking contradictions: They spent despite their escalating fears about the slow economic recovery and surging gas prices.

A group of 18 retailers ranging from discounter Target to club-operator Costco reported August sales on Thursday that rose 6 percent - the industry's best performance since March - according to trade group International Council of Shopping Centers. At the same time, the government released numbers showing that Americans spent in July at the fastest clip in five months.

The reports appear to show that what Americans say and do are two different things: The news comes two days after a private research firm said consumer confidence in August fell to its lowest level since November 2011 as Americans grew more concerned about the job market, business conditions and the overall economy.

"It shows some resilience among shoppers. Let's face it. There are a whole series of economic headwinds that they are fighting against," said Ken Perkins, president of Retail Metrics, a research firm. "The results show that the consumer isn't dead."

A small group of merchants representing roughly 13 percent of the $2.4 trillion U.S. retail industry report monthly revenue at stores open at least a year, a key measure since it excludes results from locations that open and close during the year. Some of the biggest retailers like Wal-Mart and Home Depot do not report monthly sales, but the figures still are closely watched because they offer a snapshot of consumer spending, which accounts for more than 70 percent of economic activity.

August's results are important because they offer insight into the back-to-school season - the second most important selling period behind the winter holidays - which runs from mid-July through mid-September. Retailers and economists often use the results from back-to-school as a litmus test of how shoppers will behave during the biggest shopping period of the year in November and December.

The gains in August is better than the growth 4- to 5-percent gain Wall Street predicted at the beginning of the month. And it was the best performance since March, when stores collectively posted a gain of 6.8 percent. Except for a shopping lull in June, stores have seen a healthy pace of anywhere from 4 percent to nearly 7 percent growth since the beginning of the year.

A number of retailers posted strong gains. Costco Wholesale Corp.'s revenue from stores open at least a year climbed 6 percent, beating the 4.5 percent rise analysts surveyed by Thomson Reuters had anticipated. And Target Corp. reported a 4.2 percent increase in revenue at stores opened at least a year. That was better than the 3.1 percent increase that analysts had expected.

"Sales were stronger in the second half of the month," said Gregg Steinhafel, Target's chairman, president and chief executive officer in a statement.

The strong sales reports are an encouraging sign for retailers at a time when there are signs that consumers are becoming impatient with the slowly improving economy. The New York-based Conference Board's Consumer Confidence Index fell to 60.6, down from a revised 65.4 in July. The index now stands at the lowest point since November 2011 when the reading was at 55.2. It's also still far below the 90-reading that indicates a healthy economy.

Several factors may have dampened consumers' moods in August. Gas prices, which had fell sharply from a peak of $3.94 in April, have begun rising again in the last few weeks. And the jobs and housing markets are showing only modest signs of improvement.

Home prices rose 0.5 percent in June from the same month last year, the first year-over-year increase since the summer of 2010, according to The Standard & Poor's/Case-Shiller home price index that was released Tuesday. And on the job market front, employers added 163,000 jobs in July, the most since February. But that's not enough to keep up with a rising population, and the unemployment rate increased to 8.3 percent from 8.2 percent in June.

And there are no signs the job market will significantly improve anytime soon. The applications of people applying for unemployment benefits are a measure of the pace of layoffs. When they fall consistently below 375,000, it generally suggests that hiring is strong enough to lower the unemployment rate. But the Labor Department said Thursday that the number of Americans seeking unemployment benefits was unchanged last week at a seasonally adjusted 374,000, which further suggests slow improvement. The four-week moving average, a less volatile measure, increased to 370,250.

Most economists say stronger growth is needed to produce enough jobs to lower unemployment - and make Americans feel better. The economy grew at an annual rate of 1.5 percent from April through June, down from 2 percent in the first quarter and 4.1 percent in the fourth quarter of 2011.

Despite their concerns about the snail pace recovery, Americans are spending, which could boost an economy mired in subpar growth. The Commerce Department said Thursday that consumer spending rose 0.4 percent in July from June, following no change in June and a slight decline in May. Income grew 0.3 percent, matching the gains from May and June.

Man shot by mistake at India Olympics celebration

A police officer accidentally shot dead a 64-year-old man at homecoming celebrations in India for Olympic bronze medal-winning boxer Mary Kom, officials said Tuesday.

Kom was greeted by large crowds in Churachandpur town in the remote northeastern state of Manipur when the reception in her honour was interrupted by the gunshot.

The victim was rushed to hospital but died of his injuries after the accident on Sunday, while the police constable has been arrested.

"It was a freak accidental firing that led to the death of a man named Dongjapao during the celebrations," police official A. Singh told AFP by telephone.

Singh said the cultural and entertainment programme had continued after the shooting.

Kom, who was born in a village near Churachandpur, had to settle for bronze at London 2012 after she was beaten by Britain's Nicola Adams, who went on to win the gold medal.

The mother-of-two is a national hero in India and is seen as a symbol of unity as she hails from Manipur, a state bordering Myanmar that has been hit by separatist violence for decades.

The Times of India reported that Manipur authorities had awarded her $135,000 in cash, three acres (1.2 hectares) of land on which to set up a boxing academy and a promotion to the post of superintendent of police.

CLEVELAND (AP) - Tommy Milone and the entire Oakland pitching staff have plenty of nothing as far as the Cleveland Indians are concerned.

The Athletics continued to pile up zeroes as Milone and three relievers shut out Cleveland for the third straight time, beating the Indians 7-0 on Tuesday night.

"Just par for the course. Our guys are unbelievable," said Oakland's Brandon Moss, who homered and drove in three runs as the Athletics won their fourth straight to remain tied with Baltimore for the AL wild-card lead.

Moss and Chris Carter homered off Zach McAllister (5-5) as Oakland moved to 5-0 this month against Cleveland with its 10th win in 12 games since dropping eight of 13.

"Another strong pitching performance and you can always live with that," Athletics manager Bob Melvin said.

Milone (11-9) worked six innings. Jerry Blevins, Pat Neshek and Evan Scribner completed the eight-hitter.

Oakland is 14 games over .500 (71-57) for the first time since finishing 2006 at 93-69 and has the best overall record since the start of July at 34-15.

The Indians have lost 12 of 13, are 5-25 since July 27, and scoreless in 45 of their last 48 innings overall.

"A loss is a loss," Indians manager Manny Acta said. "Every single one of them hurts. We couldn't execute at all."

Oakland has outscored the Indians 17-0 in their last three meetings. It started with a 7-0 home win Aug. 19 behind Jarrod Parker's eight strong innings. Brett Anderson worked seven innings in a 3-0 win on Monday.

"I think it is more about us being in a good stretch," Melvin said. "They have a lot of guys in their lineup that get your attention."

It is the first time in 23 years that Cleveland has been blanked three straight times by a team. Oakland did it in June 1989.

Cleveland's offensive futility was on full display in the fourth, when the Indians put runners on second and third with no outs. Milone struck out Casey Kotchman and Jason Donald. Third baseman Josh Donaldson then made a barehanded scoop and throw on a slow roller to retire Jason Kipnis at first to keep the shutout intact.

"Tommy did his best work with runners on base that inning," Melvin said.

Milone agreed.

"I didn't have my best stuff, but was able to get through it," the left-hander said. "They got those guys on, I took a deep breath and was able to make some pitches. You do that, it puts a fire under you."

McAllister struck out the side in the first, then yielded four singles to fall behind 2-0 in the second. Moss had Oakland's third straight hit to make it 1-0. Adam Rosales added a two-out RBI single.

Moss made it 4-0 in the third by hitting a 3-2 pitch for his 14th homer. It came one out after Seth Smith doubled.

Carter homered to open the fifth for a 5-0 lead. It was his 12th homer in 46 games since being recalled from the minors.

"They've done a tremendous job since coming up at almost the same time," Milone said of the duo who often share time at first base. Moss played left field in place of Coco Crisp, who fouled a ball off his right foot Monday.

Carter had an RBI double in the ninth off reliever Joe Smith, who allowed another run on a wild pitch.

McAllister struck out a career-high eight over only 4 1-3 innings. The right-hander gave up nine hits and five runs to drop to 1-3 in six starts in August. He had not allowed more than three earned runs in any of his previous nine starts at Progressive Field.

Indians reliever Esmil Rogers struck out the side in the eighth and Carlos Santana dropped each third strike, throwing to first baseman Kotchman for the putout. Santana also had to throw to first to complete two of McAllister's strikeouts.

Twitter is appealing a judge's ruling to hand over to prosecutors the tweets and account information of an?Occupy Wall Street protester.

The protester,?Malcolm Harris, is?being tried for disorderly conduct in connection with the?Occupy Wall Street march on the Brooklyn Bridge last fall. Authorities are trying?to use Twitter?posts made by Harris between September and December 2011?to prosecute him.

Harris has also filed a civil proceeding to block Criminal Court Judge Matthew Sciarrino's ruling that the information be turned over to the Manhattan district attorney's office.

In its?filing?Monday, Twitter asks the court to reverse the judge's order that it turn over the information. In part, Twitter said:

The American Civil Liberties Union plans to file a brief in support of Twitter.

In a blog posting ACLU attorney Aden Fine wrote that "the information demanded by the DA includes not only the contents of Harris?s tweets, but his private subscriber information ? including the IP addresses he used to access Twitter over three-plus months, which can reveal his physical location throughout that entire period."?

The D.A.'s office "also asked for the date, time, and duration of each of his Twitter sessions. By denying Twitter?s and Harris?s challenge, the court held that the government can access this wealth of sensitive personal information without satisfying basic constitutional protections. That isn't right."

So far, the?Manhattan D.A.'s?Office has declined to comment on the appeal.

Saudi deals boosted US arms sales to record $66.3 billion in 2011

WASHINGTON (Reuters) - Weapons sales by the United States tripled in 2011 to a record high, pumped up by $33.4 billion in sales to Saudi Arabia, but the international arms market is not likely to continue growing, according to a comprehensive new congressional report.

The United States sold $66.3 billion of weapons overseas in 2011, accounting for nearly 78 percent of all global arms sales, which rose to $85.3 billion in 2011, the highest level seen since 2004. The previous U.S. record was set in 2008, when arms sales reached $38.2 billion, measured in 2011 dollars.

"The extraordinary total value of U.S. weapons orders in 2011 distorts the current picture of the global arms trade market," said the report by the nonpartisan Congressional Research Service, calling $66.3 billion in U.S. arms sales "a clear outlier figure."

While Washington remained the world's leading arms supplier, nearly all other major suppliers, except France, saw declines in 2011, according to the annual report prepared for Congress.

France signed arms sales valued at $4.4 billion in 2011, up from $1.8 billion a year earlier, but Russia, the world's number two arms dealer, saw its sales nearly halved to $4.8 billion in 2011. The four major European suppliers -- France, the United Kingdom, Germany, and Italy -- saw their collective market share drop to 7.2 percent in 2011 from 12.2 percent a year earlier.

Saudi Arabia was the biggest arms buyer among developing countries, concluding $33.7 billion in weapons deals in 2011, followed by India with purchases of $6.9 billion and the United Arab Emirates with $4.5 billion.

Total annual global arms sales ranged between $42 billion and $67 billion in the period from 2004 to 2011, reaching a cumulative total of $467.9 billion in that 8-year period.

A weaker global economy, the European financial crisis and the slow international recovery from the recession of 2008 have dampened demand for new weapons, with many countries putting off or scaling back their purchases, the report found.

The report said some countries were focused more heavily on upgrading existing systems and support services, which remained "a rather lucrative" sector for weapons suppliers.

Washington, for instance, generates a steady stream of orders for upgrades, spare parts, ammunition and support services from year to year, even when it does not conclude big deals for new weapons systems, the report said.

Concerns about Iran continued to fuel arms sales to the Middle East and especially Saudi Arabia and the United Arab Emirates, but India, Taiwan and other Asian countries were important arms buyers as well, said the report, written by Richard Grimmett and Paul Kerr.

The report predicted increasingly intense competition between European nations and the United States for a small number of global orders in coming years.

It also noted that developing countries were demanding greater cost offsets in their arms contracts, access to more advanced technology and provisions allowing them to produce some weapons at home.

Key U.S. weapons sales in 2011 included:

- $33.4 billion to Saudi Arabia for 84 Boeing Co F-15 fighters, dozens of helicopters built by Boeing and Sikorsky Aircraft, a unit of United Technologies Corp,

- $3.49 billion for Lockheed Martin Corp's Terminal High Altitude Area Defense, an advanced missile shield, to the United Arab Emirates, and $940 million for 16 Chinook helicopters built by Boeing,

- $1.4 billion for 18 F-16 fighter jets built by Lockheed Martin,

- a $4.1 billion agreement with India for 10 C-17 transport planes built by Boeing,

- and a $2 billion order by Taiwan for Patriot antimissile batteries.

WASHINGTON (Reuters) - Republicans, who have postponed the start of their national convention in Tampa, Florida, by one day because of the threat from Tropical Storm Isaac, will not delay it further and will start the proceedings on Tuesday, the party's chairman said on Sunday.

"We're 100 percent full-steam ahead on Tuesday," Republican National Committee Chairman Reince Priebus told CNN.

The convention where Mitt Romney will be nominated as the party's candidate to challenge President Barack Obama in the November 6 election was originally scheduled to run from Monday to Thursday.

Priebus said on Saturday that the convention would start its business on Tuesday afternoon because of Isaac. A new schedule is coming out later on Sunday including an exact start time on Tuesday, he told CNN.

"So far, the word is that almost all of it is going to be accommodated into the Tuesday-Wednesday programming," Priebus said. "I think you're going to see that there might be some shortening of speeches. But most of our guests are going to be accommodated."

Asked whether the Republicans' message would be drowned by Isaac, Priebus said: "We're going to tell the Mitt Romney story, we're still going to prosecute the president on what he promised, what he delivered, and why we think we need to save this country and put Mitt Romney in the White House."

Isaac was expected to hit the Florida Keys late Sunday at or near hurricane strength. Tampa, located on Florida's west coast, faces a threat of both winds and heavy rains from the storm as it moves through the Gulf of Mexico, the U.S. National Hurricane Center said.

LOS ANGELES - Arte Moreno invested $250 million in December to get Albert Pujols.

Before Saturday, who would have thought that price was low-ball?

Had Guggenheim Baseball Management taken control of the Dodgers during last season instead of this one, Moreno, in the resultant, unavoidable bidding war for Pujols, might have lost everything up to and including his eyebrows.

Outspending the St. Louis Cardinals took some deep pockets. Outspending these guys would have taken some shallow oceans.

So, Angels fans, embrace your good luck today. After what the Dodgers' new owners just did ? bought, pretty much, the Boston Red Sox ? they almost certainly would have parted with the necessary millions to sign Pujols. Plus another $50 million or so, just to be safe.

These guys have financial clout the same way Melky Cabrera had pharmaceutical clout. To an offending degree.

"We're fortunate," Dodgers general manager Ned Colletti said, "to have the backing that we have here."

Fortunate? That's one way to describe possessing the wherewithal to drop more than a quarter of the billion dollars on an All-Star first baseman, a broken outfielder, a pitcher with six victories in his past 25 starts and Nick Punto.

Now, just imagine how plentiful things will be around here after the Dodgers sign their new television deal after the 2013 season.

If Moreno could sell images of the Angels to Fox Sports for $3 billion, the Guggenheim group might negotiate a TV contract that pays out in caviar made of plutonium spread on toast-points encrusted with diamonds.

"It's clear," Dodgers manager Don Mattingly announced. "We're just here to win."

Or spend more than the gross national product of Indonesia trying.

Hey, we're not whining, not bemoaning the lost art of player development or the newly found art ? at least locally ? of purchasing a pennant. If the Yankees can do it for generations, why can't the Angels and Dodgers do it for now?

When the Guggenheim guys took over the Dodgers in the spring ? price tag: $2.15 billion ? they promised to be aggressive in making home improvements and unafraid of investing the needed funds.

Asked about those claims Saturday, after his owners assumed 14 years and $262.5 million in contracts from the Red Sox, Mattingly had to admit, "Well, I didn't think it would be quite like this."

No one did. No one foresaw 53-year-old Magic Johnson leading a fast break that spews money. No one figured a guy named Mark Walter ? Guggenheim's CEO ? would be agreeing to purchase a $102.5-million outfielder (Carl Crawford) who, because of surgery, currently is incapable of picking up a baseball, never mind throwing the thing.

The Dodgers once built an empire on the backs of a homegrown infield. That was the old-fashioned way of operating, a blueprint as classic and quaint as a Dodger Dog.

Though they say grassroots baseball will remain the foundation, these Guggenheim guys also see no reason to wait around for the sprouts to appear.

The new Dodgers? They could be the first team in baseball history to field a solid gold second baseman.

"It is," Colletti said, "a different place now."

A few hours later, Dodger Stadium was an unglued place. Adrian Gonzalez, the main piece acquired from Boston, homered in his first at-bat, a three-run shot that was as well timed as a Cirque du Soleil routine and at least twice as theatric.

The Dodgers eventually won, 8-2, completing maybe the most dramatic day in baseball history that didn't include someone lifting the World Series trophy.

Gonzalez was born in San Diego, but he obviously understands Hollywood. After flying cross-country just to get here, what better way to continue establishing your new career path than by driving yourself home?

As the son of Mexican parents, Gonzalez would seem to be an ideal fit here, similar to how Fernando Valenzuela's presence once filled Chavez Ravine as sweetly as the sound of the Dodger Stadium organ.

"Wow," Johnson said. "I think we're going to get a different kind of mania going."

So this is what the National League West is now up against. This is what baseball is now up against. This is what the Angels are now up against.

Moreno used to reign over Frank McCourt, who had a paper fortune. The Dodgers' new owners have a paper fortune, too. It's green on one side, gray on the other and, when stacked real high, can buy enough potential and hope to maybe rescue an entire summer.

The rivalry between the Dodgers and Angels never has been more interesting than it is right now. Both teams are desperately pursuing the Southland's next World Series title, willing to pay whatever price ? literally ? is necessary.

It's a great time to be a baseball fan around here, whether you're L.A. or Anaheim, Tinsel Town or Disneyland.

And Gonzalez fit right in, even before that first at-bat. When he arrived at Dodger Stadium for Saturday's game, he did so in a T-shirt bearing the likeness of a cartoon character: Mickey Mouse.

NY gunman quiet loner, victim outgoing family man

NEW YORK (AP) ? A gunman who killed a former co-worker in cold blood in the shadow of the Empire State Building and then was shot dead by police after he turned his gun on them spent long hours in the quiet of Central Park, photographing hawks and marveling over nature's beauty.

His victim was a gregarious salesman, beloved by his nieces and nephews as the fun uncle who could talk with equal expertise about the New York Jets and the women's fashion accessories he sold.

Investigators on Saturday were trying to piece together what caused Jeffrey Johnson, a T-shirt designer, to ambush Steve Ercolino, an apparel company vice president, a day earlier outside the Manhattan offices of the company where they once were colleagues.

Police said Johnson hid behind a car and then killed Ercolino with five gunshots as he arrived for work. Johnson then was shot by two police officers who confronted him on a busy sidewalk.

Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.

Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.

Nine bystanders were wounded in the 16-shot volley, likely by stray or ricocheting police bullets. None of their injuries was life-threatening, police said.

Police investigating Johnson's killing of Ercolino were eyeing bad blood between them from when they worked together at Hazan Import, a garment district business where Ercolino was a vice president of sales.

Johnson and Ercolino had traded harassment accusations when they worked together, police said, and when Johnson was laid off from the company a year ago he blamed Ercolino, saying he hadn't aggressively marketed his new T-shirt line.

After Johnson's layoff, neighbors said, he continued to leave his apartment every day in a suit.

Internet records listed Johnson as the administrator of the website for a business called St. Jolly's Art, which sold iron-on graphic art for T-shirts. Art for sale on the site included stylized drawings of fighter planes and muscle cars and whimsical "seafaring vignettes" featuring pirate maidens and tall ships.

Johnson also was part of a community of bird watchers and photographers who document hawks and other wildlife living in Central Park, a few blocks from his home.

In one email to another bird watcher who works at The Associated Press, Johnson wrote tenderly about spending a winter night watching ducks in the park.

"Near midnight by the Harlem Meer I watched a little 'flotilla' of Mallards swimming and softly honking ... fifteen degree temp and they were carrying on unfazed. Just remarkable," he wrote.

His photographs of Central Park's hawk population appeared regularly on blogs tracking the birds.

A neighbor who often saw Johnson, 58, said he was always alone.

"I always felt bad," said Gisela Casella, who lived a few floors above Johnson in a modest apartment building on the Upper East Side. "I said, 'Doesn't he have a girlfriend?' I never saw him with anybody."

Ercolino, 41, was described by his relatives as the opposite of a quiet loner.

His eldest brother, Paul Ercolino, said he was a gregarious salesman who often traveled, had a loving girlfriend and was the life of any family gathering.

"He was in the prime of his life," he said. "He would do anything for anybody at any time. ... He was so wonderful with my children. At Christmastime, he was the one who always had the best presents for the kids."

Paul Ercolino said his brother, known to nieces and nephews as Uncle Ducky because of his nearly blond hair, had followed his father into the garment industry after growing up in Nanuet, just north of New York City, then later worked in women's handbags and accessories. He said his brother had never mentioned to the family that he had any problems with a co-worker.

Hazan Import Corp. executives didn't return phone calls seeking comment Friday.

Johnson, after waiting for Steve Ercolino to come to work, walked up to him, pulled out a .45-caliber pistol and fired at his head, police Commissioner Ray Kelly said. After Ercolino fell to the ground, Johnson stood over him and shot four more times, a witness told investigators.

"Jeffrey just came from behind two cars, pulled out his gun, put it up to Steve's head and shot him," said Carol Timan, whose daughter, Irene Timan, was walking to Hazan Imports at the time with Ercolino.

In security camera footage released by the police, Johnson can be seen walking calmly down the sidewalk after the shooting, distancing himself slightly from the other pedestrians, who appear to have no awareness that anything is wrong.

But when two police officers approach in a hurry, Johnson turns and pulls a handgun from a bag. Then, the scene explodes into action. People seated on a bench behind the gunman and pedestrians standing close to the two officers run for their lives.

Only a young child seems not to react, strolling out of view of the camera as adults all around leap away in terror.

Startled New Yorkers later looked up from their morning routines in the crowded business district to see people sprawled in the streets bleeding and a tarp covering a body in front of the tourist landmark.

"I was on the bus, and people were yelling 'Get down! Get down!" accountant Marc Engel said. "I was thinking, 'You people are crazy. No one is shooting in the middle of midtown Manhattan at 9 o'clock in the morning.'"

It was over in seconds, he said ? "a lot of pop, pop, pop, pop, one shot after the other."

Afterward, he saw sidewalks littered with the wounded, including one man "dripping enough blood to leave a stream."

The officers who fired were part a detail regularly assigned to patrol landmarks such as the 1,454-foot-tall skyscraper since the Sept. 11 terror attacks, officials said.

Kelly, the police commissioner, said the officers who confronted Johnson had "a gun right in their face" and "responded quickly, and they responded appropriately."

"These officers, having looked at the tape myself, had absolutely no choice," he said.

A witness had told police that Johnson fired at the officers, but authorities say ballistics evidence doesn't support that. Johnson's gun held seven rounds, they said. He fired five times at Ercolino, one round was still in the gun and one was ejected when officers secured it, authorities said.

A loaded magazine was found in Johnson's briefcase.

Johnson legally bought the gun in Sarasota, Fla., in 1991, but he didn't have a permit to possess it in New York City, authorities said.

Mayor Michael Bloomberg said New York still is the safest big city in the country, on pace to have a record low number of murders this year.

"But we are not immune to the national problem of gun violence," he said of the shooting, following mass shootings at a Colorado movie theater and a Sikh temple in Wisconsin.

The nine people wounded outside the Empire State Building were all from New York City, except for a woman from Chapel Hill, N.C. They suffered graze wounds or other minor injuries.

Metal detectors and bag searchers have been standard at the Empire State Building since 1997, when a gunman opened fire on the 86th-floor observation deck, killing one tourist and wounding six others before fatally shooting himself.

The skyscraper remained open Friday throughout the mayhem, although its workers became witnesses.

"We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, a worker at a nearby souvenir shop.

He said he rushed from the building and saw seven people lying on the ground, covered in blood.

Rebecca Fox said she saw people running down the street and initially thought it was a celebrity sighting, but then she saw a woman shot in the foot and a man dead on the ground.

"I was scared and shocked and literally shaking," she said. "It was like 'CSI,' but it was real."
