Cybercrime disclosures rare despite new SEC rule

WASHINGTON (AP) ? Hackers broke into computers at hotel giant Wyndham Worldwide Corp. three times in two years and stole credit card information belonging to hundreds of thousands of customers. Wyndham didn't report the break-in in corporate filings even though the Securities and Exchange Commission wants companies to inform investors of cybercrimes.

Amid whispers of sensational online break-ins resulting in millions of dollars in losses, it remains remarkably difficult to identify corporate victims of cybercrimes. Companies are afraid that going public would damage their reputations, sink stock prices or spark lawsuits.

The chairman of the Senate Commerce, Science and Transportation Committee, Sen. Jay Rockefeller, D-W.Va., is adding a provision to cybersecurity legislation that would strengthen the reporting requirement. The SEC's guidance issued in October is not mandatory. It was intended to update for the digital age a requirement that companies report "material risks" that investors want to know.

Rockefeller's measure would direct the SEC's five commissioners to make clear when companies must disclose cyber breaches and spell out steps they are taking to protect their computer networks from electronic intrusions.

The SEC recently challenged Internet retailer Amazon's decision to omit from its 2011 annual report references to the online theft of customer data held by Zappos, an online shoe company owned by Amazon. Amazon eventually agreed to modify the statement slightly, according to correspondence between the company and the SEC. But the company still argued that the Zappos attack was not covered by the commission's cybersecurity guidance because it had no material impact on Amazon's business.

Cybercrime is rampant and not confined to the United States. The head of Britain's domestic spy agency said this week that cybersecurity ranks alongside terrorism as one of the United Kingdom's most pressing security challenges. In one recent case, an unspecified, London-listed company hit by a cyberattack incurred revenue losses of $1.2 billion, MI5 Director General Jonathan Evans said in rare public remarks in London. He did not identify the company or say which country was behind the attack. The U.S. has said China and Russia are the governments most frequently engaged in such hacking.

"What is at stake is not just our government secrets but also the safety and security of our infrastructure, the intellectual property that underpins our future prosperity, and the commercially sensitive information that is the lifeblood of our companies and corporations," Evans said.

Research by a cybersecurity expert shows dozens of Fortune 500 companies have lost a wide range of valuable information to cybercrimes, including intellectual property, bank account credentials, restricted data about patients of pharmaceutical companies and internal legal records.

Rodney Joffe of Neustar, an Internet infrastructure management company in Virginia, monitors networks used by online criminal groups and traces the origin of stolen information. He found evidence that 162 out 168 companies in the manufacturing, chemical and transportation sectors had been compromised. The names of the companies are being kept confidential for proprietary reasons, he said.

"No one is safe. Everyone is compromised," said Joffe, Neustar's senior technologist. "When people tell you, 'We are protected as a company,' they are really fooling themselves."

The SEC isn't tracking how many companies comply with its cybersecurity guidance. But publicly traded companies historically have resisted supplying information about cyber incidents because it highlights their weak spots, said Peter Toren, a former federal prosecutor with the Justice Department's computer crime division.

"It just doesn't look good," Toren said.

The breach of Wyndham's computers was described in a Federal Trade Commission lawsuit filed this week against the company and three subsidiaries for alleged security failures that led to the three data breaches between April 2008 and January 2010. The failures caused "the export of hundreds of thousands of consumers' payment card account information to an Internet domain address registered in Russia" and millions of dollars in fraudulent charges on consumers' accounts, the FTC said.

Wyndham didn't mention the break-ins in its 2011 annual report or prior securities filings, according to an Associated Press review of the records.

Wyndham's 2011 annual report said the "hospitality industry is under increasing attack by cyber-criminals in the U.S. and other jurisdictions in which we operate" and noted that it was involved in "claims relating to information security and data privacy." Wyndham spent $13 million more on security improvements and expects to spend as much as $100 million in 2012 to guard against "the increasingly aggressive global threat from cyber-criminals," according to the report.

Wyndham said in an emailed statement to The Associated Press that it "fully complied with SEC regulations in regards to the disclosure of material events." In the statement, Wyndham said the incidents were "previously reported," an apparent reference to notices to consumers that were published on the company's website. The company also said the FTC's claims were without merit.

Network infrastructure company Verisign reported in late October, just a few weeks after the SEC issued the guidance, that there had been several successful cyberattacks against its corporate networks in 2010. In the filing, Verisign said the company's management had not been informed of the attacks until September 2011.

LinkedIn, the online networking service, publicly announced on June 12 the online theft of 6.5 million user passwords. It said the announcement complies with its obligations to the SEC, but it has yet to file a report about the incident with the commission.

The new SEC guidance puts pressure on companies to decide whether to disclose a breach or keep it secret, said Jody Westby of Global Cyber Risk, a consulting firm. But she said the demand for information amounts to locking the door after the house has been robbed.

"The SEC would have done better to require all public companies to say whether they've taken actions to implement a security program," Westby said.

Facebook, Twitter make young girls seem more aggressive, expert says

Facebook and Twitter are making teenage girls come across as more aggressive, according to a language campaigner cited in the British media.

Language employed by social media users is becoming shorter, sharper and more "to the point," Marie Clair, from Britain's Plain English Campaign, told the Daily Mail.?

As a result, the many teenage users of such media have less time to deliberate carefully over their words, and can come across as curt, straightforward and even aggressive when speaking to one another and adults.

The change is more noticeable in girls than boys because they communicate more frequently, Clair said.

"Young people?s language in general is becoming more direct in comparison to their parents and the business community because of the communication channels they?re more familiar with.

"Those fast communication channels of Facebook, email and Twitter [that] they?ve grown up with mean they haven?t got as much time to deliberate and choose their words.

"That?s perhaps why they come across as being more aggressive. It?s not intentional. Curtness tends to be short, sharp and to the point. But it?s a fine line between being curt or aggressive and being straightforward."

Earlier this year, author Sir Terry Pratchett suggested the use of Twitter and texting had led to increasing frustration among youths, the Daily Telegraph reported.?

"Kids now seem unmotivated. Social media is not helping and texting certainly isn't. You have to have interaction with other people," Pratchett reportedly said.

"If you have the words to identify exactly what you mean, you can get your message across. I'm sure this is linked to rough behavior."

And actor Ralph Fiennes famously lamented that modern language was "being eroded" in "a world of truncated sentences, sound bites and Twitter."

"Our expressiveness and our ease with some words is being diluted so that the sentence with more than one clause is a problem for us, and the word of more than two syllables is a problem for us," Fiennes ? who does not use Twitter ? said, according to the Daily Mail reported.?

However, not everybody agreed that jargon commonly used in social media was harming the English language.

The Utah Statesman ? the Utah State University paper ? pointed out in a recent editorial that the English language had been "transforming constantly."?

"We?ve created a new language through social media... We believe that many elderly people would agree the English language was ruined with the invention of rap music. It?s all relative, really. A problem does exist when a social media user fails to capitalize sentences in employment cover letters due to poor tweeting habits. People can?t be that daft, can they? We prefer to think optimistically about our generation."

Let's face it: I was handpicked from obscurity to become the face of television's new talk/variety show IFC's Comedy Bang! Bang! There is a lot of pressure on me to create some "classic TV moments" that could air during future Emmy broadcasts (and during my inevitable "In Memorium" segment).

What else to do but to turn to talk shows of yore for inspiration? What are my personal picks for the best talk show moments of all time? Continue forth, gentle reader...

  • Jason Voorhees on "The Arsenio Hall Show" - When Talk Show Guests Go Silent

    For a spell in the nineteen-hundred-and-nineties, appearing on Arsenio Hall's show was the hippest thing you could do, so it makes sense that he was able to land guests that no other show could procure. But the dog pound was certainly not ready for this! Arsenio wasn't afraid to ask the tough questions of his non-syllabic guest, like why he's killing fewer people in his newest movie, what caused him to be so angry and become a killer (because he was cut from the hockey team in high school?). And while <em>Friday the 13th Part 8</em> may not be remembered by history, this incredible "no talking" talk show appearance surely will.

London 2012 Olympics: Locog bows to public pressure and opens eventing inspections to spectators

Spectator gates at Greenwich Park will now open earlier, at 7.45am, and the horse inspection will begin at the later time of 8.15am.

Spectator access is in the International Equestrian Federation?s (FEI) rules for Olympic Games in the interests of transparency.

Thomas deemed it ?disgraceful? and ?bureaucratic claptrap? that Locog had not arranged to accommodate them.

The initial horse inspection on July 27 is still out of bounds, due to logistical problems on the opening ceremony day, though it is arguably less important.

Ingmar De Vos, FEI secretary-general, said: ?The FEI is happy that Locog has revised the access schedule to allow spectators into the venue in plenty of time to watch the final horse inspection.

"July 31 is a particularly important day as it is the day when the first medals will be decided in equestrian sport?s centenary year.?

Podcasting Search Engine - Success Internet Business

It is much easier for search engines to index text blogs than podcasts or videoblogs. At present, search engines are using link text and the text surrounding the links to podcasts and videoblogs as a means to index their contents. The situation is admittedly a far cry from the ideal but the great strides being seen in the development of technologies towards the indexing of these mediacasts are very encouraging.

Podcasting in Relation to Search Engines

Podcasting is the method of distributing multi-media files over the Internet using either the RSS or atom-syndication formats, for playback on mobile devices and personal computers. This may include, but is not limited to, audio programs and music videos. Podcast can mean both the content and method of delivery while a podcaster is the host or author of a podcast.

The websites of podcasters may offer direct download or streaming of their files. A podcast usually features a single type of show with new episodes introduced regularly or sporadically, although there are podcast networks that feature multiple shows on the same feed. It can be downloaded automatically using software capable of reading RSS or atom feeds.

The term podcasting is technically a misnomer as it combines two words: iPod and broadcasting. It does not require an iPod or over-the-air broadcasting. The ?pod? name association stemmed from the popularity of the iPod digital audio player during the time that podcasting began. A lot of other terms have been suggested for use but the term stuck and remained as such.

Like any other regular websites that aim to be found by searchers, search engines have much to contribute towards this end including podcasts. Podcast optimization can be achieved by promoting only one feed. Many podcasters commit the mistake of creating a podcast and then moving over to a different management system which entails promoting a new RSS feed. This usually results to a lot of different feeds for every podcast which may be disadvantageous in the long run.

Another way to get the most out of podcasts is by optimizing the audio file. The findability gap should be closed since a lot of people listen to a podcast on their computers as well as their MP3 players. A landing page can be optimized for each episode of the show as well as the category page. Subscription information that is very visible on the landing page is highly recommended.

Podcasters should also look into building correct and valid feeds with feed validation tools. Since iTunes do not redistribute, a separate feed must be built for it. Doing three separate feeds ? a 2.0 feed, a media feed and an iTunes feed is ideal.

Generally, major search engines are not indexing podcasts in a format that is easy to find. However, some podcast-specific search engines seem to have solved some of the problems. Podscope searches for the spoken words within the podcasts themselves. Yahoo! Podcasts is very user friendly and is one of the more consistent and useful in finding good podcasts. Singing Fish provides a whole ream of results by just typing in podcast or bring back audio results only when specified with the use of drop-down menus on the top left. Other worthy research engines includes Podzinger, Blinkx, BlogDigger and Lycos Audio Search.

Aside from search engines, podcast directories are virtual goldmines for finding good podcasts. The Podcast http://Alley.com includes the very useful Top Ten Podcasts of the Month as voted by listeners. The NPR Podcast Directory contains quality podcasts in a subject directory format. The http://Podcast.net categorizes podcasts of various subjects by tags which are available for free download. Podcast Bunker is likewise one of the best places to find quality podcasts on the web.

Search engines have become very useful especially to those who don?t particularly enjoy the search process. http://Podzinger.com allows the user to search podcasts in the same way as searching for anything else in the web. A word or phrase typed in will find relevant broadcasts and highlights the segment of the audio in which they occurred. It is not perfect but it serves the user?s need at this time. It works with a speech-recognition software which transforms audio into words. http://Podscope.com and Blinkx are sites that work in a similar way.

Podzinger and Blinkx are search engines that scour audio content for keywords by translating the audio into text and creating an index for quick searching. This is a step ahead of traditional search engines that can only identify keywords in a podcast?s Meta data such as the headline and introductory notes which describes the audio file?s general content.

Podzinger has officially ended its beta and lets users jump to the spot in a podcast where their search term appears. This is a welcome option to being forced to scan an entire program for pertinent parts such as with Blinkx. The design results to an uncluttered search page similar to those of Google. Podcasters can also link to a searchable index of their content in order to sell sponsored links to text in the index provided by Podzinger.

Both Podzinger and Blinkx include information about the source of the podcast as well as excerpts of text translated from the podcast. This comes with the added convenience of having relevant search terms highlighted. In this regard, Podzinger?s information is more extensive while allowing users to hear excerpts and determine its relevancy before downloading the entire podcast.

Podscope searches podcasts but scans only for sounds of syllable rather than full words. It has operated a keyword search engine for video and radio broadcast since 1999. By far, the Blinkx service is a bit more extensive as it scours thousands of podcast and offers search for 1 million hours of TV news video and the content of academic lectures.

The problem at hand for podcast search is the difficulty in finding what is really needed in podcasts. Relevant results cannot be attained without words thus the heavy reliance on speech recognition software that would help the public search for on-line video and radio content. Podcasts are a priority at this time due to popularity boom it is currently experiencing. The aim is to make the spoken word as searchable as the printed word.

Michael Jackson

The pet tiger Michael Jackson used to keep at Neverland Ranch recently died of lung cancer at actress Tippi Hedren's Shambala Preserve in California.

The tiger "Thriller" and her brother "Sabu" were moved from Jackson's ranch in Santa Barbara to Hedren's sanctuary in Action following Jackson's child molestation court case in 2006.

Thriller, 13, died on June 11. She was cremated and Hedren and her staff are planing a private memorial service.

Strangely, Jackson never checked on his tigers or offer to help with the animals' upkeep, according to the Associated Press. The actress even sent a package of photos of Sabu and Thriller, T-shirts, and other memorabilia to Jackson's children a year after the big cats arrived at Shambala.

Hedren got no response from the Jacksons.?

"I just think it's odd," she commented.

Infoaxe?s Flipora Passes 8M Registered Users, Adds Discovery Engine

Since then, they've rebranded as Flipora, passed 8 million registered users and they're now adding another key piece to their product -- a discovery engine that helps users figure out what to visit next on the web. They're calling it a "Pandora for websites." "There is so much great stuff on the web," said co-founder Jonathan Siddharth. Facebook signs privacy agreement for mobile app

SAN FRANCISCO: Facebook became the seventh company to agree to give people advance warning if its mobile applications pull personal information from mobile phones and tablet computers.

California Attorney General Kamala D Harris said Friday that the agreement includes Facebook's own applications, as well as those made by third parties in its recently-launched App Center.

The agreement requires mobile apps seeking to collect personal information to display their privacy policies before their app is installed on a device.

Facebook says it incorporated the principles of the privacy agreement when it was designing its App Center.

The other six companies are Apple, Google, Amazon.com, Microsoft, Research in Motion and Hewlett-Packard Co.

Chinese spacecraft docks with orbiting module

A Chinese spacecraft carrying three astronauts docked manually with an orbiting module on Sunday, a first for the country as it strives to match American and Russian exploits in space.

The Shenzhou 9 capsule's maneuver with the Tiangong 1 module was shown live on national television. It follows a docking last week that was carried out by remote control from a ground base in China.

The Chinese astronauts have been living and working in the module for the past week as part of preparations for manning a permanent space station. They returned to the Shenzhou 9 capsule early Sunday and disconnected in preparation for the manual reconnection.

Wu Ping, spokeswoman for China's manned space program, told reporters in Beijing that hand levers were used to control Shenzhou 9 and position it to dock with the orbiting module. The maneuver was "precise and perfect" and the three astronauts carried it out "calmly and skillfully," Wu said.

"This success in manual docking represents a major breakthrough in our space rendezvous and docking technologies," Wu said.

China's next goals include another manned mission to the module later this year and replacing Tiangong 1, which was launched last year, with a permanent space station around 2020. Possible future missions could also include sending a man to the moon.

China's permanent space station is to weigh about 60 tons, slightly smaller than NASA's Skylab of the 1970s and about one-sixth the size of the 16-nation International Space Station.

The Shenzhou 9 crew includes 33-year-old Liu Yang, an air force pilot and China's first female space traveler. Liu is joined by mission commander and veteran astronaut Jing Haipeng, 45, and crew mate Liu Wang, 43.

Their mission, which is expected to last at least 10 days, is China's fourth manned mission. Shenzhou 9 launched June 16 from the Jiuquan center on the edge of the Gobi desert in northern China.

Wu said the astronauts will spend three to four more days in the module before returning to the capsule and manually separating from Tiangong 1. Once back in Shenzhou 9, they will return to Earth within a day, she said.

China is hoping to join the United States and Russia as the only countries to send independently maintained space stations into orbit. It is already one of just three nations to have launched manned spacecraft on their own.

Wu said China spent 20 billion yuan (US$3.1 billion) on its space program between 1992 and 2005. By the time the next Shenzhou mission is completed, Beijing will have spent an additional 19 billion yuan (US$3 billion), she said.

(AP) ? Jerry Sandusky's lawyers said Saturday they tried to quit at the start of jury selection in his child sex abuse trial because they weren't given enough time to prepare, raising an argument on the trial's speed that could become the thrust of an appeal.

And one of the jurors who convicted Sandusky of 45 child sex abuse counts said Saturday he was swayed by the "very convincing" testimony of eight accusers who said the retired Penn State assistant football coach molested them for years.

"It's hard to judge character on the stand, because you don't know these kids," juror Joshua Harper told NBC's "Today" show. "But most were very credible ? I would say all."

A day after Sandusky's conviction, his lawyers disclosed they felt too unprepared to adequately defend him because of how quickly the case was brought to trial. Experts have said the seven months between Sandusky's November arrest and trial was fast-paced by Pennsylvania standards.

"We told the trial court, the Superior Court and the Supreme Court we were not prepared to proceed to trial in June due to numerous issues, and we asked to withdraw from the case for those reasons," attorney Joe Amendola told The Associated Press.

The issues included a scheduling conflict with a defense team member and the need to read a cache of documents produced by a lengthy grand jury investigation. Judge John Cleland denied their request.

The attorneys raised other issues that could be part of the future appeal, saying a mistrial was sought and denied over a repetition at trial of a brief part of a November interview Sandusky had with NBC's Bob Costas.

Jurors in the two-week trial convicted Sandusky of 45 of the 48 counts against him, meaning Sandusky, 68, likely will die in prison.

Harper said the accusers who testified one by one of horrific abuse at Sandusky's hands were each believable, "but then also the fact that we saw this corroborating story between all of them. It was very convincing."

Then Sandusky's impassive face when the verdict was read was confirmation for the jury, he said.

"I looked at him during the reading of the verdict and just the look on his face. No real emotion," he said, "because he knew it was true."

Harper said jurors had some issues with the testimony of Mike McQueary, a then-assistant who said he saw Sandusky assaulting a boy in the Penn State showers in 2001; jurors acquitted Sandusky on one count relating to the incident.

The case is poised to move to an investigation of university officials' role in reporting the charges; two ex-school administrators face trial on charges they didn't properly report McQueary's account of the suspected abuse in 2001.

Almost immediately after the verdict, Penn State President Rodney Erickson signaled an openness to quickly settle potential civil lawsuits arising from the convictions, saying the school "wants to provide a forum where the university can privately, expeditiously and fairly address the victims' concerns and compensate them for claims."

The university recently reported a $1.8 billion endowment. But both sides have reasons not to want to go to court, said Jason Kutulakis, a Harrisburg-area lawyer who specializes in child welfare and juvenile law. Victims are reluctant to get on the stand and have their credibility attacked, he said.

But "Penn State's got so much egg on their face, they probably just want to make it all go away," he said.

For now, the school is facing one lawsuit from an accuser, Travis Weaver, who was not among those represented in the criminal case against Sandusky.

Lawyers for McQueary, who testified against Sandusky, have signaled their intent to sue, along with a lawyer for one accuser, so-called Victim 5.

Jeff Anderson, who represents Weaver, said that he represents more victims of Sandusky's and that he will ask the court to allow him to begin seeking information from Penn State in Weaver's case.

The next step is to determine the extent of Penn State's culpability, lawyers say. In part, that means finding out who in the university's upper ranks knew Sandusky was preying on boys and could have stopped it.

The former Penn State officials facing charges, athletic director Tim Curley and retired vice president Gary Schultz, are charged with lying to a grand jury about what they knew of a 2001 incident in which McQueary said he saw Sandusky assaulting a boy in a football team shower.

A separate investigation by ex-FBI director Louis Freeh, who was hired by Penn State's board of trustees to investigate the university's handling of the Sandusky allegations, is due later this summer.

Hall of Fame coach Joe Paterno was fired for a failure of leadership for not going to the police after McQueary told him about that incident. The scandal also caused the departure of university president Graham Spanier.

Philadelphia-based lawyer Fortunato Perri Jr., who followed the trial, said the jury's dismissal of the charge involving the 2001 shower incident could help Curley and Schultz' defense.

"You've now had a jury kind of preview your case with respect to the credibility of McQueary, and they didn't believe him," Perri said. "Who knows if the next jury would believe him or not believe him?"

But the administrators' attorneys would probably be precluded from introducing the acquittal evidence at the separate trial, Perri said.

Sandusky's sentencing is expected to occur in about three months; an exact date hasn't been set. Because of the severity of the charges and mandatory minimum sentences, he faces an effective life sentence.

Until his next court date, Sandusky is one of 272 inmates at the Centre County Correctional Facility, seven miles from the Penn State campus. He was kept under watch overnight and is allowed access to some personal items including a prayer book, and can get visits from family, friends and attorneys.

Rominger said he planned to visit him on Sunday.
